Agreement
These Terms of Service (“Terms”) govern your use of kavella.com (the “Site”) and any purchase from Kavella LLC (“Kavella,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms.

Kavella operates an online store for haircare products. We do not operate a physical retail storefront open to the public.

Eligibility
You must be able to form a binding contract to use the Site and place orders. If you use the Site on behalf of someone else, you confirm you have authority to agree to these Terms for them.
Accounts
You may create a customer account, but you do not have to. If you do, keep your account information accurate and your login credentials confidential. You are responsible for activity under your account.
Products and orders
We work to keep product information on the Site accurate and up to date. If we find an error that affects an order, we will correct it and contact you.
Prices are in U.S. dollars and may change. Applicable taxes are calculated at checkout where required.
Placing an order is an offer to buy. We may accept, refuse, or cancel an order (for example, for availability, pricing error, suspected fraud, or shipping limits). If we cancel after payment, we will refund amounts paid for the canceled items.
Payment
Payment is processed by third-party payment providers. Kavella does not store full payment card numbers on its own servers.
Shipping
Shipping areas, processing times, carriers, delivery estimates, free shipping, and related rules are set out in our Shipping Policy. That policy is part of these Terms by reference.
Returns, replacements, and delivery issues
Returns, replacements, samples, lost or misdelivered packages, and payment-dispute expectations are set out in our Refund Policy. That policy is part of these Terms by reference.
Samples and product guidance
We may offer samples and product guidance to help you choose. Hair results vary. Samples and guidance are not a guarantee of results and do not create a right to return full-size products beyond what the Refund Policy allows.
Intellectual property
The Site, Kavella name and marks, product names, text, images, and other content are owned by Kavella. You may not copy, scrape, or reuse them for commercial purposes without our written permission.
Acceptable use
You agree not to misuse the Site, including by attempting unauthorized access, interfering with the Site, submitting false information, committing fraud, scraping the Site, or using the Site in a way that harms Kavella, other customers, or third parties.
Disclaimers
The Site and products are provided on an “as is” and “as available” basis to the fullest extent permitted by law. Kavella products are cosmetics/personal care items, not medical treatments. Nothing on the Site is medical advice.
Limitation of liability
To the fullest extent permitted by law, Kavella is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the Site or any purchase.
To the fullest extent permitted by law, Kavella’s total liability for any claim related to the Site or an order is limited to the amount you paid to Kavella for the order giving rise to the claim.
Where the law does not allow these limits, Kavella’s liability is limited to the maximum the law allows.
Indemnity
You agree to indemnify and hold Kavella harmless from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your breach of these Terms, or your violation of law or third-party rights.
Dispute resolution
If a dispute arises from these Terms or your use of the Site that we cannot resolve through care@kavella.com, either party may require binding individual arbitration in Iowa under the rules of a recognized arbitration provider. You and Kavella waive class actions to the extent allowed by law. Either party may still bring a qualifying claim in small claims court. This section does not limit chargebacks or other payment-network disputes.
Governing law
These Terms are governed by the laws of the State of Iowa, without regard to conflict-of-law rules. Subject to the Dispute resolution section, courts located in Iowa will have jurisdiction over disputes arising from these Terms or your use of the Site, except where prohibited by law.
Changes
We may update these Terms from time to time. The version posted on this page is the current version. Continued use of the Site after changes means you accept the updated Terms.
